چکیده
هوش مصنوعی و تولیدات مبتنی بر آن به دلیل نوظهور و بدیع بودن و ویژگی های منحصــر به فرد و قابلیت هایی نهادینه شــده در خود، افزون بر مزایای بی بدیل، می تواند ریسک ها، چالش ها و خطراتی را برای فعالان این عرصه ایجاد کند؛ از این رو حقوق دانان ســعی در تنظیم و تدوین سیاســت ها و پوشش های متناســب با خطرات خاص هوش مصنوعی داشــته اند. در این خصوص، کشــورهای غربی و اروپایی سازِکارهای حقوقی مختلفی پیشبینی کرده اند، لیکن تاکنون ســازکار جامعی برای تضمین خســارات وارده ناشی از هوش مصنوعی به دست نیامده است.
این مقاله به روش توصیفی- تحلیلی، در تدبیر برای این خلاء، نهاد بیمه را به عنوان راهکار تضمین منافع استفاده کنندگان از هوش مصنوعی پیشنهاد می دهد تا از طرف بیمه شــده در برابر پیامدهای اقتصادی، خطرات و آســیب های زیان بار احتمالی آن محافظت نماید. مؤلفه های مکانیسم بیمه در مورد خسارات ناشی از هوش مصنوعی عبارت است از: تطبیق قرارداد بیمه با ویژگی های هوش مصنوعی، سپردن عناصر خاص بیمه نامه های هوش مصنوعی به شــرکت های بیمه، دســته بندی مســؤولیت و خطرات ناشی از آن و بیمه نمودن بر اســاس این دسته بندی، ایجاد زیرساخت های لازم با نظارت دولت و بیمه اجباری عمده تولیدات مبتنی بر هوش مصنوعی.

چکیده English

Artificial intelligence and AI-based productions, owing to their emerging and novel nature and their unique characteristics and inherent capabilities, in addition to their unparalleled advantages, can create risks, challenges, and dangers for actors in this field. Therefore, legal scholars have sought to regulate and formulate policies and coverage appropriate to the specific risks of artificial intelligence. In this regard, Western and European countries have envisaged various legal mechanisms; however, so far no comprehensive mechanism has been developed to ensure compensation for damages arising from artificial intelligence. This article, using a descriptive-analytical approach, proposes an insurance institution as a solution to guarantee the interests of users of artificial intelligence in order to protect the insured against its economic consequences, risks, and possible harmful damages. The components of the insurance mechanism for losses caused by artificial intelligence include: adapting the insurance contract to the characteristics of artificial intelligence, entrusting specific elements of artificial intelligence insurance policies to insurance companies, classifying liability and the risks arising from it and insuring based on this classification, creating the necessary infrastructure with government supervision, and mandatory insurance of major artificial intelligence-based products.
